Marriage Cases

I don't have time for that tonight. The Fish Wrapper reports that three Justices seemed skeptical of the petitioners' arguments and three Justices seemed skeptical of the respondents' arguments and Chief Justice George seemed skeptical of all of them.

Apparently almost no one briefed the issue of Proposition 22 (Family Code §§ 300, 308.5) and wehther the Court could change or overrule this referendum statute -- or what impact its role, as an expression of direct democracy, would have on the Court's examination of the other questions before it.

We can expect a ruling on June 2, 2008.
